STATE OF THE NATION JULY 2013

More than 100 days into the UHURUTO regime and this is a snapshot  of our situation A.       POLITICALLY -           We have a president who rode on ICC hinged impunity to state house. Consequently, he is doing every good gimmick to win Kenyans. However, in the PR gimmicks lies the problem, what will happen once the president is tired of all these PR shenanigans e.g. wearing same shirts with deputy -           We have a deputy president whose cards are slowly dwindling. He now remains with only one ace Card i.e. the Pastoralist Community. That is what it has been all about i.e. the many appointments from the wider pastoralist community. However, a recent court ruling only goes to show that other land cases may be resurrected any time. Remember, there was the ngong forest land saga of which he was cleared because the prosecution witnesses declined to test...

KEY LEGISLATIVE ISSUES KENYA SHOULD ADDRESS

Kenya is a country in mid-life crisis; I have heard they that understand what a Mid Life crisis is say. I still have some years before I get into the dip of middle life ages but I guess, going by my experience as a Kenya, I bet I understand what this middle life crisis is. Currently in Kenya, everything looks normal yet it is not normal. We seem to be progressing and yet not. We seem to have achieved yet not. We seem to have put dictatorship before us and yet not. We seem to have liberated ourselves from tribal dominion and yet not.  The Uhuruto government is very promising; but just as it promises greatness, it also seems to have seeds of destruction. We seem to have broken from the past and yet the status quo seems intact. One of the things that gives us much hope is the new constitution. However, the constitution in itself are just papers and words on the papers. The operationalization of the constition is dependent on the operational bills passed by parliament, the good wil...

THE DEVELOPMENTAL COUNTY IN A DEVOLVED KENYA

INTRODUCTION In the recently released TJRC report, development is mooted as one of the ways by which historical injustices can be dealt with. It has been said again and again that social injustices in Kenya are the biggest mines that are bound to explode sooner than later. Social injustices exist in many forms but most pronounced as economic exploitation. There are those who were traditionally privileged e.g. the clerks and home guards in the colonial administration, who took the reigns of power at independence. The injustices in the form of social marginalization perpetuated by successive governments explain why Kenya remains highly polarized along tribal lines. There is a perception that governments exist to favor their people over and above perceived enemy tribes or communities. REDISTRIBUTION THROUGH DEVOLUTION Devolution is billed to bring development closer to the people and enhance community participation in development. Through devolved units, the necessary redistrib...

CONSTITUTIONALISM FAILING, BENOVELENT DICTATORSHIP IS WELCOME

In 2010, I wasted my money and time going to vote to ensure Kenya Realizes a new constitution. I knew that the new constitution puts in place mechanisms that entrench the rule of law.     Laws are important to the extent they embody the spirit and aspirations of the people. However, having a constitution is one thing but entrenching constitutionalism is another ball game all together. While we celebrated the realization of the new constitution, we forgot that constitutions only work if people are willing to subject themselves to the constitution. Why am I already disappointed? Well, the more things change in Kenya, the more they remain the same. Two vital institutions that would facilitate and ensure constitutionalism is entrenched are the presidency and parliament. However, what has happened? a.       Misgivings of The 10 th Parliament The tenth parliament did not respect the spirit of the constitution in many ways. They showed us that t...
